Agreement of Terms 

All terms “I”, “us”, “we”, “Tonja”, “Tonja Roberts” refer to and are the same as Tonja Roberts Art. By using this website and/or purchasing anything on this website at present or in the future you are agreeing to all terms and policies in the Terms of Service, including but not limited to original art, art prints, and any and all merchandise present and/or future. If you do not agree to the terms herein do not use this website or purchase from Tonja Roberts Art.   

Intellectual Property Notice

Rights to artwork remain the sole property of Tonja Roberts before and after purchase of any and all artworks including originals, prints, commissions, and current or future productions Of any kind. The purchase of any item or product does not grant the customer permission to mint the piece into an NFT, print and/or distribute in any form or fashion or reproduce in any way including for profit or otherwise. All work protected by federal copywrite law. 

Liability

The collector is responsible for goods once received. Tonja Roberts Art claims no responsibility or duty to refund, exchange, replace or compensate for the damage of products that have been mishandled by customers.  Irresponsible or rough handling of art ie; tearing or smudging of prints, cutting or crushing of artworks due to mishandling and/or careless unpackaging or storage etc. will be the responsibility of the customer/purchaser of said artworks.  

Compensation for damaged art or products purchased from Tonja Roberts Art will be guaranteed in the event of damage by postal service other delivery services or due to the faulty dispatch of faulty merchandise and will only be compensated upon Tonja Roberts Art receiving the damaged order and inspecting it. Each artwork including prints is inspected for quality control and chosen to be in pristine condition before it is shipped.  

Please read the product descriptions and dimensions carefully before choosing your art. It is not our duty to compensate customers who do not read product descriptions prior to purchase. 

RETURNS and Refunds 

It is my intention for you the customer to be happy with your purchase.  If you aren’t satisfied or something goes wrong with your purchase I will do everything I can to make things right. It is not my responsibility to compensate simply because the customer changes their mind. Only faulty merchandise is covered by obligation.  I will try to work with you however.  I honor a 14 day return policy on eligible products.  I do my best to photograph my art as true in color to the actual piece as possible. Please be mindful that different monitors and electronic devices can give varying degrees of color change. Check the piece online on multiple screens/devices as you feel gives you peace of mind that the color  is accurate. 

To be eligible for a return your item must be in the same condition as when I sent it. Prints in their original packaging can be returned but prints that have been handled, smudged, made dirty, torn, will not. Upon inspection by me, and if the print is in acceptable condition a return will be granted. I reserve the right to deny refund.  

All original sales are final unless damaged and according to the above stated. Originals are otherwise not eligible for refund. 

Commissions are nonreturnable and nonrefundable. One half of the cost of the commission is due before the commissioned piece is started and is non refundable even if the collector has a change of mind. The second half of the commission is due upon approval by the collector.  I keep regular contact with the collector before, during and upon completion of all commissioned pieces to help guarantee there are no misunderstandings and that the work is acceptable to the collector. 

ADDRESS CHANGE

If you need an address change after ordering, please contact me with the change within 48 hours of ordering in order to guarantee you get your order.  I’m unable to redirect the postal service once shipment has occurred. Use the contact page provided here in my website to contact me as soon as possible.  Tonja Roberts is not responsible for undelivered products because of incorrect or incomplete shipping information. Please ensure you provide the complete and correct mailing address at checkout.  

Duties and Taxes

Tonja Roberts Art is located in Oklahoma, United States of America and is not liable for import fees on any products purchased.  This includes but is not limited to originals, prints and other merchandise.  It is the responsibility of the customer to pay duties, taxes, customs fees, and any all similar charges to get the order to its destination.  

All items are declared at purchase value for exporting, and documents will not be falsified under any circumstances.
